These terms and conditions ("Terms") govern the use of DRAW STORE, a platform provided by DRAW Space, located in Newtown, Sydney. By using DRAW STORE, you agree to adhere to and be bound by these formal Terms. Please carefully review them before using our platform.
Introduction
DRAW Space serves as an intermediary, connecting artists and buyers in the context of contemporary drawing.
DRAW STORE, a part of the DRAW Space website, is the platform for sharing and potentially purchasing artworks.
Purpose
Our primary objective at DRAW STORE is to empower artists, support the drawing community, and assist collectors in acquiring high-quality Australian drawings.
Artists retain 100% of the sale proceeds. We do not charge any fees or commissions.
DRAW Space Fundraiser
Items marked as 'DRAW Space Fundraiser' are donated by prominent Australian artists. All proceeds from these sales support emerging artists in exhibiting with DRAW Space.
Responsibility for Payment
DRAW Space does not process payments directly. A work is only considered sold when the artist and buyer confirm the payment.
Responsibility for Sales
DRAW Space's responsibility is limited to introducing buyers to artists. We do not take responsibility for the sale beyond this introduction.
The artist is responsible for receiving payment and arranging the secure delivery of the artwork.
Any issues or disputes related to the sale, including payment and delivery, should be resolved directly between the buyer and the artist.
What are the artist’s responsibilities?
On receiving a purchase request, the artist is expected to email the buyer with the payment method and cost of shipping and delivery.
If the artist is registered for GST the sale price should include GST and this should be indicated.
On receipt of payment, the artist is responsible for packing, shipping and delivery of the artwork in a secure and timely manner.
The artist should not send an artwork until payment is received, but once it is received the artist should promptly send the work to buyer.
The artist should keep sufficient funds available, in case an artwork is returned and reimbursement is required. On receiving the returned work, the artist should refund the buyer promptly.
Once a work has been sold the artist should email DRAW STORE at info@drawspace.org with an image and details for a replacement work.
The artist can ask for their work to be removed at any time.
Artists should indicated whether works are framed, if no indication is given the works are understood to be unframed.
What are the buyers responsibilities?
To purchase a work, a buyer hits the ‘BUY’ button beside an artwork, which initiates an email to the artist. The buyer should include information such as name, contact details and mailing address, so the artist can calculate delivery costs.
On receiving the artist’s preferred payment method, and cost including delivery, the buyer should pay promptly and email confirmation of payment e.g., the bank transfer receipt, to the artist.
On receiving the payment, the artist will send the artwork.
Returns Policy
If the buyer is not happy with a purchase, they should contact the artist immediately (within one week of receiving the work) to let them know that the work is being returned and the preferred reimbursement method. The buyer should then return the work promptly to the artist.
Buyers are responsible for all costs associated with returning the work, including appropriate packaging, shipping and delivery methods.
On receiving the returned artwork, the artist will reimburse the buyer.
What is DRAW Store’s responsibility in terms of individual artists work?
DRAW STORE provides a platform for buyers and artists to connect.
DRAW STORE take no responsibility for payment, packaging, or shipping of artworks - this is the responsibility of the artist.
DRAW STORE take no responsibility for the state of artwork once it is delivered - the artist should securely package the work.
DRAW STORE take no responsibility for secure delivery of artwork - we recommend insurance and tracking be purchased so the artwork cannot get lost. DRAW STORE take no responsibility for lost artwork.
DRAW STORE take no responsibility for refunds or the cost of returning artwork.
What is DRAW Store’s responsibility in terms of ‘Fundraiser’ works?
DRAW STORE will take responsibility for payment, appropriately packaging, and delivery of artworks,
DRAW STORE will purchase insurance and tracking for delivery of all ‘Fundraiser’ works, and this will be included in the sale price,
DRAW STORE will provide refunds for returned ‘Fundraiser’ artworks.
Privacy
By using DRAW STORE, you consent to the collection and use of personal information in accordance with our Privacy Policy.
User Conduct
Users must use DRAW STORE for lawful and ethical purposes.
Harmful or disruptive behavior is strictly prohibited and may result in the termination of access to the platform.
Intellectual Property
All intellectual property rights related to the artwork remain with the artist.
Any use, reproduction, or distribution of the artwork beyond the sale must be agreed upon with the artist.
Termination
DRAW Space reserves the right to terminate or suspend access to DRAW STORE at any time without prior notice for violations of these Terms or disruptive behavior.
Modification
DRAW Space reserves the right to update, modify, or change these Terms at its discretion.
Any changes will be posted on the DRAW STORE website, and continued use of the platform constitutes acceptance of the modified Terms.
Governing Law
These Terms are governed by the laws of New South Wales, Australia.
Any disputes arising from or in connection with these Terms will be subject to the exclusive jurisdiction of the courts in New South Wales.
